U.S. District Court Judge Dabney Friedrich in a two hour hearing, questioned whether the DOJ’s felony indictment of obstruction of an official proceeding.

The criminal charge is one prosecutors have leveled against at least 265 of the more than 700 Jan. 6 defendants, according to DOJ statistics issued earlier this month. It is a serious charge that has a maximum sentence of 20 years.

The issue came to a head Friday at a hearing for Reffitt. Reffitt’s attorney, William Welch, has asked Friedrich to dismiss the obstruction charge.
